Terms of Use Agreement

The Encyclopedia of Arkansas History & Culture (“the Encyclopedia”) and its copyright holder, the Central Arkansas Library System (CALS), make the Encyclopedia of Arkansas website www.encyclopediaofarkansas.net (the “Site”), including all information, documents, files, text, graphics, audio, and video (collectively, the “Materials”), available for your use subject to these terms and conditions set forth in this document and any changes to this document that the Encyclopedia may publish from time to time (collectively, the “Agreement”).

By accessing or using the Site in any way, or merely browsing the Site, you agree to and are bound by the Agreement. Your use of the Site will be subject to the most current version of the Agreement, rules, and guidelines posted on the Site at the time of such use. If you breach any part of the Agreement, your authorization to use this Site automatically terminates, and any Materials downloaded or printed from the Site in violation of the Agreement must be immediately destroyed.

CALS reserves the right to collect, to use, and to distribute demographic data about you and your use of the Site in forms that do not identify you individually or reveal your identity.

Copyright and Trademark Rights

All portions of this Site and its Materials, including entries, site design, logo, title, graphics, software, text and functionality of the search, and browse and linking methods, are copyright and trademark protected under U.S. and International law and may not be reproduced, duplicated, copied, sold, or otherwise used for any commercial purpose. Any unauthorized use of the Materials on this Site may violate such laws and this Agreement. Except as expressly provided herein, the Encyclopedia and its suppliers do not grant any express or implied rights to use the Materials and the Site. You agree not to copy, download, transmit, modify, rent, lease, loan, sell, distribute, license, sublicense, reverse engineer, or create derivative works based on the Site or its Materials or their selection and arrangement, except as expressly authorized herein. In addition, you agree not to use any robots or similar data extraction methods in connection with the Site.

All photographs, text, code, and other media appearing on the Site are the exclusive property of the copyright holders and are protected under United States and International Copyright Laws. Photographs, illustrations, video, audio files, text, code, and other media may not be reproduced, copied, stored, or manipulated in any form without the written permission of the respective copyright holders. This includes use of any image as part of another photographic concept or illustration. No image or any part of this Site by its appearance here should be construed as within the public domain.

The trademarks, logos, and service marks ("Marks") displayed on this Site are the property of CALS or other third parties. You are not permitted to use the Marks without the prior written consent of CALS or such third party that may own the Marks.

Neither the Encyclopedia nor CALS grants permission to utilize frames or any other technology hardware or software to capture any portion of this Site.

A limited license is granted to the users of the Site for the purpose of linking to the main page of the Site with the restriction that the link is placed on the user’s page in such a way that it does not damage the reputation or accessibility of the Encyclopedia of Arkansas Site, its parent organization, or the persons involved in constructing the Site. All links to the pages contained within the Encyclopedia of Arkansas Site or those beyond the main page of the Site must be pre-approved by the Encyclopedia.

Fair Use of Copyrighted Material

In every case, the Encyclopedia makes an attempt to identify the legal copyright holder of the text, photographic, video, audio, or other media portions of the Site. If you feel that the display of text, photographic, video, audio, and/or audio media of this Site do not give proper credit to the creator or copyright holder of said items, please contact the Encyclopedia of Arkansas staff.

The use of copyrighted materials for educational purposes by non-profit organizations is protected under the U.S. and International Copyright Office “Fair Use” policy. The Encyclopedia utilizes text, photographic, video, audio, and other media portions of this Site under the rights of “Fair Use” for non-profit, educational purposes.

The downloading, reprinting, or other utilization of materials contained within the Encyclopedia of Arkansas Site by non-profit, educational institutions or organizations does not require permission from the Encyclopedia or CALS. Individual users must determine if their use of the Materials falls under “Fair Use” guidelines, and does not infringe on the proprietary rights of the legal copyright holders.

Except as indicated to the contrary, you may view, download, and print Encyclopedia Materials available on this Site subject to the following conditions:

  1. The Material may be used solely for personal, informational, and internal purposes.
  2. The Material may not be modified or altered in any way.
  3. The Material may not be distributed or sold, rented, leased, or licensed to others.
  4. You may not remove any copyright or other proprietary notices contained in the Material.
  5. The Encyclopedia reserves the right to revoke the authorization to view, download, and print the Material available on this Site at any time, and any such use shall be discontinued immediately upon notice from copyright holders.
  6. The rights granted to you constitute a license and not a transfer of title.

The rights specified above to view, download, and print Encyclopedia Material available on this Site are not applicable to the design or layout of this Site. Such elements of this Site are protected by trade dress and other laws and may not be copied or imitated in whole or in part.

Disclaimer of Warranties and Limitation of Liability

You expressly agree that use of the Site is at your sole risk. Neither CALS, its affiliates, nor any of its employees, agents, third party content providers, or licensors warrant that the Site will be uninterrupted or error free. Nor do they make any warranty as to the availability, accuracy, reliability, completeness, or contents of any Material found on the Site, and merchandise or services provided through the Site, or any links to other sites made available on the Site.

In no event will CALS (or any of its parents, subsidiaries, affiliates, employees, agents, third party content providers, or licensors, and their respective directors, officers, employees, and agents) be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, any Material or the Site itself. These limitations apply regardless of whether the party liable or allegedly liable was advised, had other reason to know, or in fact knew of the possibility of such damages. You specifically acknowledge and agree that CALS (and any of its parents, subsidiaries, affiliates, employees, agents, third party content providers, or licensors, and their respective directors, officers, employees, and agents) is not liable for any defamatory, offensive, or illegal conduct of any user, including you.

Termination

CALS may terminate this Agreement and your use of the Site at any time. CALS shall have the right immediately to terminate your use of the Site in the event of any conduct by you which CALS, in its sole discretion, considers to be unacceptable, or in the event of any breach by you of this Agreement.
